PRIVACY POLICY

PURPOSE OF THE PRIVACY POLICY

Kindra Connect, Inc. (“us”, “we” or “Kindra Connect”) values your privacy and has created this privacy policy (the “Privacy Policy”) so that you can understand our privacy policies and practices. The Privacy Policy describes:

  • how we collect, store, protect, use and share information, content and materials (collectively, “Information”) about you when you access, view and use the Kinlia mobile application and the Kinlia website at kinlia.com (collectively, the “Kinlia App”) on your device; and
  • your choices regarding our collection, use and sharing of Information about you.

Please read the Privacy Policy carefully. By accessing, using or viewing the Kinlia App, you explicitly understand, acknowledge and agree that we may, and you explicitly authorize us to, collect, store, transfer, use and share Information about you as described in the Privacy Policy.

The Privacy Policy was last updated, and is effective as of, the date indicated above under “Updated Date”. As the Kinlia App evolves, we expect to update and revise the Privacy Policy from time to time. We will notify you by email or notifications on the Kinlia App if we have made material changes to the Privacy Policy. If you continue to access, view or use the Kinlia App after any changes to the Privacy Policy become effective, then you agree to the revised Privacy Policy and you understand, acknowledge and agree that the revised Privacy Policy supersedes any prior versions of the Privacy Policy.

1. INFORMATION WE COLLECT AND STORE ABOUT YOU

We will collect and store “Personally Identifiable Information” about you. When we refer to Personally Identifiable Information, we mean Information that can actually identify a specific natural living person or that can be used to contact a specific natural living person (e.g., a first and last name, an email address, a phone number or a mobile device identification). We will not share your Personally Identifiable Information except as discussed below.

Information You Provide

To use, access or view certain features of the Kinlia App, you may need to create an account (“Your Account”) by signing up on the Kinlia App. You can sign up on the Kinlia App using your phone number (verified via SMS) or, for some accounts, using your email address and a password. When you sign up, you explicitly understand, acknowledge and agree that we will, and you explicitly authorize us to, collect and store Personally Identifiable Information about you consisting of your phone number and/or email address.

Your Profile Information. On the Kinlia mobile application, you may set up a profile (“Your Profile”) and provide personal Information about yourself (“Your Info”), including your:

  • first name and last name;
  • email address;
  • mobile phone number;
  • zip code and city;
  • age;
  • gender;
  • personal bio (“A Little About Me”);
  • interests and identity tags (“Who I am”);
  • type of connections you are seeking (e.g., friendship, networking, creative collaboration, romantic);
  • job;
  • childhood home;
  • astrological sign;
  • pets;
  • social media accounts;
  • a description of yourself in three words;
  • what you are seeking on the platform; and
  • profile photographs.

The minimum Information that you will be required to provide is your first name, email address or phone number, age, gender and zip code. You may voluntarily provide or decline to provide all other requested Information. By viewing, accessing or using the Kinlia App, you explicitly understand, acknowledge and agree that we will, and you explicitly authorize us to, collect and store any and all Information you provide to us in Your Info.

Ticket Purchase Information

When you purchase tickets for events through the Kinlia App, we collect the following Information:

  • buyer’s first name, last name, email address and phone number;
  • attendee first name, last name, email address and phone number (for each ticket);
  • answers to any custom questions set by the event organizer; and
  • payment card brand and last four digits (full payment details are processed and stored by our third-party payment processor, Stripe).

Email Subscription Information

When you subscribe to receive communications from us through the Kinlia website (e.g., via the “Join” page), we collect your email address and postal code.

Community Information

When you join communities on the Kinlia App, we collect Information about the communities you have joined, your role within those communities (e.g., member, moderator, organizer), and any messages or content you post in community chat features.

Your Public Information

Your Public Information consists of any and all Information that you make publicly visible on Your Profile, including (without limitation) photographs, text and other content you post on Your Profile, as well as any content you post in community chats or event discussions that are visible to other users of the Kinlia App (“Other Users”).

We consider private messages that you send to Other Users to be private between you and those Other Users. Accordingly, we will not access, view, use or share those communications (except in the circumstances described below under paragraph “3. HOW WE SHARE YOUR INFORMATION - Legal Disclosures”). However, we cannot control how you or Other Users use or share those communications. Therefore, we treat any and all Information that you communicate to Other Users as part of Your Public Information.

In addition, we may collect and store your communications with us (through email or otherwise), including your email address and any complaints that we may receive from you about Other Users or from Other Users about you and any comments, opinions, suggestions or feedback (and any ideas, concepts, know-how, techniques, designs or inventions contained in them) that we may receive from you about the Kinlia App, events or communities on the Kinlia App or any other matters.

By accessing, viewing or using the Kinlia App, you explicitly understand, acknowledge and agree that we will, and you explicitly authorize us to, collect and store any and all Information comprising Your Public Information and all of your communications with us.

Log-in and Usage Data

We (or third party service providers acting on our behalf) automatically collect certain information from your browser or mobile device when you use the Kinlia App. This information may include, among other things:

  • pages you visit on the Kinlia App; how you interact with and use the Kinlia App; and the features you use and activities you engage in while using the Kinlia App (e.g., browsing events, purchasing tickets, joining communities, viewing profiles);
  • access dates and times;
  • your device’s identification, type, operating system, resolution, mobile carrier and use of wireless or wifi;
  • your browser type and language; and
  • referring website and search terms.

2. HOW WE USE YOUR INFORMATION

We may use any and all Information that we collect about you (including Personally Identifiable Information) or you provide to us and any comments, opinions, suggestions or feedback (and any ideas, concepts, know-how, techniques, designs or inventions contained in them) that we receive from you about the Kinlia App or any other matters:

  • to provide, perform, operate, develop and/or improve the services, functionalities and features we provide on the Kinlia App, and obtain financing for and manage Kindra Connect and its business;
  • to process ticket purchases, donations and other transactions;
  • to send you event reminders, ticket confirmations and other transactional communications via SMS, email or push notifications;
  • in the case of any comments, opinions, suggestions or feedback (and any ideas, concepts, know-how, techniques, designs or inventions contained in them) that we receive from you about the Kinlia App or any other matters, to accomplish any other purpose whatsoever in our sole discretion (including to develop, produce and/or market any other products or services);
  • contact you with information about the Kinlia App (such as updates or new offerings or features on the Kinlia App) and events being sponsored or promoted by us or third parties;
  • contact you to solicit your comments, opinions, suggestions and feedback about the Kinlia App, events or communities on the Kinlia App or any other matters;
  • conduct research and analytics about how you and Other Users interact with and use the Kinlia App, the features you and Other Users use and activities you and Other Users engage in while using the Kinlia App, and your and Other Users’ interest in and comments, opinions, suggestions and feedback about the Kinlia App, events or communities on the Kinlia App or any other matters;
  • conduct demographic or industry analysis;
  • provide you with customer support;
  • resolve disputes between you and Other Users;
  • share such information in the manner discussed below under the paragraph “3. HOW WE SHARE YOUR INFORMATION”; and
  • perform functions or services as otherwise described to you at the time of collection of the relevant information.

We may use your Information directly, or we may engage third parties to use your Information on our behalf, in the manner described above.

By accessing, viewing or using the Kinlia App, you explicitly understand, acknowledge and agree that we may use, and you explicitly authorize us to use, in the manner and under the circumstances described above:

  • any and all Information that you provide to us, including Your Public Information and any comments, opinions, suggestions or feedback (and any ideas, concepts, know-how, techniques, designs or inventions contained in them) we receive from you about the Kinlia App, events or communities on the Kinlia App or any other matters; and
  • any and all Information that we collect about you (including Personally Identifiable Information).

3. HOW WE SHARE YOUR INFORMATION

We will not share your Information (including Personally Identifiable Information) except in the manner or under the circumstances described below or as described above under paragraph “2. HOW WE USE YOUR INFORMATION” or otherwise without your explicit consent.

Your Public Information. You understand, acknowledge and agree that all of Your Public Information is public and non-confidential and will be immediately visible, and may be viewed, collected and used throughout the world by any person who uses, accesses or views the Kinlia App. By viewing, accessing or using the Kinlia App, you explicitly understand, acknowledge and agree that we will, and you explicitly authorize us to, process all of Your Public Information and make all of Your Public Information publicly available on the Kinlia App.

We cannot control who views Your Profile or what Other Users may do with the Information that you voluntarily post on Your Profile or communicate to Other Users. Accordingly, we urge you to consider carefully the Information that you post about yourself on Your Profile or communicate to Other Users and to be discrete and cautious with your personal information that could be abused or misused. In particular, you are not permitted to post on Your Profile:

  • any personal, private or confidential information about you or any other person, business, organization or entity, such as credit card or banking details, social security numbers, health or medical information, passwords, inside or proprietary information;
  • any content that violates the privacy of any person, including (without limitation) any video recordings, audio recordings, photographs or images of any person without that person’s explicit permission (or, in the case of a minor, the permission of the minor’s legal guardian); or
  • photographs or video recordings containing nudity.

Third Party Service Providers. We engage third parties to provide certain services and perform certain functions for us related to the Kinlia App. We may share with these third parties your Personally Identifiable Information and Information contained in Your Info, Your Profile or your communications with us or Other Users, to the extent necessary for these third parties to provide those services and perform those functions on our behalf. These third-party service providers include:

  • Stripe — for processing payments for ticket purchases and donations;
  • Twilio — for sending SMS event reminders and phone number verification;
  • SendGrid — for sending transactional and marketing emails;
  • Cloudinary — for storing and serving images and media;
  • Google Maps — for displaying event locations;
  • Google Analytics — for analyzing website usage patterns on kinlia.com;
  • Firebase Analytics — for analyzing mobile application usage patterns;
  • Firebase Cloud Messaging — for sending push notifications to mobile devices.

SMS and Mobile Phone Data. We will not share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

Legal Disclosures. We may share your Personally Identifiable Information and Information contained in Your Info, Your Profile (including your communications with Other Users) or your communications with us, without your consent or notice to you, in the following circumstances:

  • to comply with a legal demand, such as a subpoena or a court order, or a request for cooperation from law enforcement or other governmental authorities or agencies;
  • to comply with applicable laws or regulations;
  • to investigate or report suspected fraud, illegal activity or misconduct or protect the security of the Kinlia App and the safety of us or any person or entity; and
  • to protect, exercise and enforce (as applicable) our legal rights, assets, properties, agreements and policies (including our Terms of Use) and those of third parties, and to defend legal claims.

In some of the following circumstances, we may, in our sole discretion, raise or waive any legal objection or right available to us.

Business Transactions. We may share and sell or transfer your Personally Identifiable Information and Information contained in Your Info, Your Profile or your communications with us or Other Users, without your consent or notice to you, in connection with a merger or restructuring involving us, sale of any of our assets or business or our bankruptcy or dissolution.

Aggregated Non-Personal Information. We may use and share aggregated, non-personal Information about you and Other Users under the circumstances described above and also share such aggregated, non-personal Information with third parties, including potential or actual investors, lenders, marketing partners, advisors and other persons or entities, for business purposes.

4. SMS MESSAGING

We may send you SMS (text) messages in connection with your use of the Kinlia App, including event reminders for events you have purchased tickets to. By providing your phone number when purchasing tickets or creating an account, you consent to receiving these messages.

  • Message frequency: Up to 3 messages per event you have purchased tickets for.
  • Message and data rates may apply.
  • You can opt out of SMS messages at any time by replying STOP to any message.
  • For help, reply HELP to any message or contact us at support@kinlia.com.
  • Carriers are not liable for delayed or undelivered messages.

We will not share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing or promotional purposes.

5. PAYMENT PROCESSING

Ticket purchases, donations and other payments on the Kinlia App are processed by Stripe, Inc. (“Stripe”), a third-party payment processor. When you make a payment, your full payment card details are transmitted directly to and stored by Stripe and are not stored on our servers. We only store the card brand (e.g., Visa, Mastercard) and the last four digits of your card number for your reference. Stripe’s use of your personal information is governed by Stripe’s privacy policy, available at stripe.com/privacy.

6. ANALYTICS AND TRACKING TECHNOLOGIES

We use analytics tools to understand how users interact with the Kinlia App and to improve our services. Specifically:

  • Kinlia website (kinlia.com): We use Google Analytics to collect aggregated, non-personal usage data such as pages visited, session duration and general traffic patterns. We do not use cookies for tracking. You can learn more about Google Analytics’ data practices at google.com/policies/privacy/partners. You can opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on.
  • Kinlia mobile application: We use Firebase Analytics to collect aggregated usage data such as features used, session duration and device information. This data is collected using device identifiers and is used to understand how users interact with the app and to improve our services.

The analytics data we collect is used in aggregate form and is not used to personally identify individual users. We do not use cookies or similar tracking technologies on the Kinlia App.

7. DO NOT TRACK DISCLOSURE

Under California law, an operator of an online service is required to disclose (a) how it responds to “do not track” signals or other mechanisms that provide consumers a choice regarding the collection of personally identifiable information about an individual consumer’s online activities over time and across different third party Web sites or online services, if the operator engages in that collection and (b) whether other third parties may collect personally identifiable information about an individual consumer’s online activities over time and across different third party Web sites or online services when the consumer uses the operator’s online service. We do not engage in the collection of personally identifiable information about individual users of the Kinlia App regarding their online activities over time and across different third party Web sites or online services. In addition, we do not knowingly permit third parties to collect personally identifiable information about individual users of the Kinlia App regarding their online activities over time and across different third party Web sites or online services when such users are using the Kinlia App.

8. OUR DATA RETENTION POLICY

You may terminate Your Account at any time for any reason by contacting us by email at support@kinlia.com. If Your Account is terminated at your request, we will take reasonable measures to remove Your Profile from the Kinlia App within 30 days of your request, and we will take reasonable measures to delete from our records Your Profile and all other Information about you following the six-month anniversary of your request. This will enable you to reinstate Your Account and have Your Profile reinstated on the Kinlia App during this six-month period if you change your mind about terminating Your Account. You should not expect that we will be able to reinstate your Account or Your Profile after this six-month period. However, we will retain such Information about you that we reasonably determine that we need to preserve in any of the circumstances described above under “3. HOW WE SHARE YOUR INFORMATION - Legal Disclosures” and “- Business Transactions” or for legitimate business purposes (such as for analytical and recordkeeping purposes), subject to applicable legal requirements.

Please note that, even if you delete information, content or materials from Your Profile or even if we delete Your Profile from the Kinlia App, copies of such information, content or materials or Your Profile may still be available and viewable to the extent that such information, content or materials or Your Profile has been shared with others or copied or stored (e.g., by a screen shot) by Other Users. We cannot control these circumstances and are not responsible for such information, content or materials or Your Profile continuing to be available and viewable in these circumstances.

Community Chat Messages. If you terminate Your Account, messages you have posted in community chats will remain visible to other community members, but your identity will be anonymized (displayed as “Deleted User”). This is necessary to preserve the continuity and context of community conversations for other members.

9. YOUR CHOICES ABOUT COLLECTION, USE AND SHARING OF YOUR INFORMATION

The minimum Information that you will be required to provide to create Your Account is your phone number or email address. On the mobile application, to set up Your Profile, the minimum Information that you will be required to provide is your first name, age, gender and zip code. You may voluntarily provide or decline to provide all other requested Information.

Except as discussed above, we will not share your first and last name, email address or phone number with any third party without your prior consent.

You may opt-out of push notifications from us by adjusting the “notifications” setting in your mobile device. You may opt out of SMS messages by replying STOP to any message. You may opt out of email and other communications from us by following the specific instructions to unsubscribe or opt-out contained in the communication or by contacting us by email at support@kinlia.com.

10. HOW YOU CAN VIEW AND CORRECT YOUR PERSONAL INFORMATION

You are able to view and correct any Information you have provided by accessing Your Profile settings on the Kinlia mobile application and changing or deleting any Information you previously provided.

11. SECURITY OF YOUR INFORMATION

We take the security of your Information seriously. We use industry-standard security measures to help protect your Personally Identifiable Information and your other Information from loss, unauthorized access or disclosure, including encryption of data in transit (SSL/TLS), secure cloud hosting, and access controls that limit who within our organization can access your data.

However, you understand and acknowledge that mobile and web communications and applications may be subject to breaches of security and that no method of electronic transmission or storage is 100% secure. While we strive to protect your Information, it is not possible for us to guarantee the security of your Personally Identifiable Information or your other Information or your communications through the Kinlia App. Therefore, we do not represent or guarantee, and you should not expect, that your Personally Identifiable Information, other Information or communications with us or Other Users will always remain secure.

12. NOTICE CONCERNING CHILDREN

We require users of the Kinlia App to be at least 18 years of age. We do not intend for anyone under the age of 18 to use the Kinlia App in any manner, and we do not market or direct any of our content specifically to persons less than 18 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we become aware that a person under the age of 18 has set up an account or a profile on the Kinlia App, we will delete that person’s account and profile and all of that person’s Information from the Kinlia App.
